MEDIATION

We recognise that going to Court and going through legal proceedings can be daunting, stressful and costly. Where possible, and where appropriate, we try to help to resolve disputes by suggesting other forms of dispute resolution, including mediation.

Sometimes a round table meeting with all the people involved, including their legal advisers, can help to settle a dispute and can often achieve more than litigating a case through the Courts.

Mediation is a confidential process which allows the parties to a dispute to discuss their different positions facilitated by an independent mediator.

Nicola Mackintosh KC (Hon) has been an accredited mediator for over 10 years. She has been involved in many mediations in the mental capacity and community care field, with resounding success in a high proportion of cases.

Not all cases are suitable for mediation and it also depends on the stage at which a case has reached. Where we think that a case is suitable we will always suggest this because if a dispute can be resolved by avoiding contested Court proceedings, this is often better for everyone involved.
